My Store - Terms & Conditions

Additional agreement:

The following shall constitute a binding agreement between you ('the User') and Inzu Limited (trading as Inzu) ('Inzu') for your use of the My Store ('My Store') application provided by Inzu on the domains of inzu.net ('the Platform').

This agreement together with any amendments and Inzu's main terms & conditions, constitute the agreement between you and Inzu ('the Agreement').

You should review all relevant terms & conditions regularly to ensure you are aware of any amendments. Inzu will be notify you by e-mail of significant amendments. Your continued use of the Platform will constitute acceptance of the Agreement including any modifications and amendments which have been made.

Any amendments that affect the way we use your personal data will require you to provide explicit consent of those changes for continued use of the Platform. You will be notified by e-mail of such amendments with instructions on how to accept or decline such changes.

The Service

My Store is a subscription-based application available to all Inzu users. It provides an e-commerce management suite for Inzu users to upload, edit and manage both physical and digital goods for sale via their; Inzu Page, proprietary website, app, social media and other internet portals.

All goods sold via the My Store application are transacted via Inzu's Payment Gateway (payments.inzu.net).

Third-party services

  1. To sell goods via the My Store application you will need a supplementary e-commerce account with Stripe for card payments and/or a PayPal account for PayPal payments.
    1. You must fully comply with the terms and conditions of your chosen e-commerce providers at all times.
    2. Goods can be sold only if your connected e-commerce accounts are fully active and operating normally.
    3. Inzu is not liable for any disruptions of service that are the responsibility of your chosen e-commerce providers.
    4. You understand that for the purposes of tax filing, Inzu transaction records should be cross-checked with records from your e-commerce providers.
    5. You understand that your e-commerce providers may terminate your e-commerce account at any time and that Inzu may not be able to intervene in these circumstances.
    6. You understand that Inzu may refuse you access to the My Store application on the recommendation of our third-party payment processors.
    7. You agree to only connect a third-party service to your account for normal business activities or to publicly review the My Store application.
    8. You will not connect a third-party service to your account solely for research purposes.
  2. Sales taxes for goods can automatically be calculated for free by using services provided to Inzu by TaxJar.com. You accept that Inzu is not liable for any errors created by this service and that you will scrutinise sales records before submission for tax filing.

Liability

  1. To sell goods via the My Store application, you accept full liability and responsibility for the goods sold, and that you are considered the legal merchant ('Merchant'). As a Merchant your responsibilities include; product pricing, shipping costs, sales taxes, accuracy of product descriptions, legality of products, delivery/fulfilment of products (excluding digital downloads), and the safety of products.
    1. As a Merchant you must also adhere to all relevant trading and consumer laws of the United Kingdom and subsequently any stricter local laws that apply to your location of business.
    2. You will be held liable for any damages incurred by Inzu as a result of your failure to comply with the law.
  2. You understand your chosen third-party payment provider will charge you for customer chargebacks. Chargebacks occur when a customer can prove a payment was not made by them and is somehow fraudulent.

Customer service

  1. You understand you will have to deal directly with customers and that Inzu only provides software for you to manage your product inventory and to facilitate payments.
  2. Customers may contact Inzu if they are for any reason unsatisfied with your customer service, but only after 14 days from the moment of purchase.
  3. Your contact details:
    1. If you do not assign a particular account user as being the contact for mail-order receipts you accept that your main account e-mail address will be provided to customers as a means of contact.
    2. If a transaction is in dispute and the customer does not receive any communication from the User within 14 days, Inzu will pass on the address and phone number associated with the User's account to the customer.
  4. You agree to resolve disputes with customers in a timely fashion and understand that your use of the My Store application may be permanently terminated if you repeatedly fail to provide reasonable levels of customer service.
  5. You agree to make your customers fully aware of customer service facilities you provide at or before the point of sale.
  6. You agree to make your customers fully aware of your refund, delivery and any other policies regarding the sale of goods.

Physical goods

  1. You understand you are fully responsible for the packing and delivery of physical goods.
  2. You should attempt to maintain a high standard of packing and must fulfil orders as quickly as possible.
  3. You will provide clear information regarding the specifications and condition of goods you sell, ensuring the customer does not discover issues that should have been made clear before the sale occurred.
  4. Inzu provides shipping tools to help you charge for shipping - these tools do not provide a service-based shipping calculation. The differences between the shipping costs your delivery service charges and the charges you make to customers are to be managed at your discretion with the tools provided.
  5. Inzu provides an automatic sales tax tool provided by TaxJar.com. You may use this tool to automatically add sales tax to your products and shipping. If you choose to use this service, you accept the calculations made by TaxJar.com and do not hold Inzu liable for any errors resulting from these calculations.
  6. You understand that regular complaints from customers regarding the quality of your products or their delivery may result in a temporary or permanent ban for your use of the My Store application.
  7. You may sell second-hand goods providing they are clearly described as second-hand and with a full list of faults/issues is described.
  8. As per Inzu's main terms and conditions you may only sell goods that comply with Inzu's guidelines on offensive/harmful content, United Kingdom law and subsequently any laws local to your place of business/residence.

Digital goods

  1. You understand that Inzu is responsible for the delivery of digital goods.
  2. You will provide clear information regarding the specifications and condition of goods you sell, and that the customer does not discover issues with the product that should have been rightfully communicated before the sale occurred.
  3. Inzu provides an automatic sales tax tool provided by TaxJar.com. You may use this tool to automatically add sales tax to your products. If you choose to use this service, you accept the calculations made by TaxJar.com and do not hold Inzu liable for any errors resulting from these calculations.
  4. You understand that regular complaints from customers regarding the quality of your products may result in a temporary or permanent ban for your use of the My Store application.
  5. As per Inzu's main terms and conditions you may only sell goods that comply with Inzu's guidelines on offensive/harmful content, United Kingdom law and subsequently any laws local to your place of business/residence.

Marketing

  1. You agree not to use the My Store application as a means to spam, harass or mis-lead customers into purchasing your products.
  2. You understand that the "offers" facility allows you to create discounts for your products and that you are responsible for the discounts you create, how many times a discount may be used and when the discount will expire.
  3. Any free gifts or prizes that you offer must be fully described to the customer and must not mis-lead them in terms of the value offered.

Limitations of Usage

  1. You understand that to publish products from the My Store application on your own website domain, you or your web developer will need sufficient technical experience to work with a JSON based API.
  2. You understand that Inzu does not provide a unified shopping experience across its network where your products may be found via searching (or browsing) product categories, nor does Inzu market, promote or otherwise actively engage the public with the products you sell. You are responsible for generating your own sales.

Privacy

  1. By using the My Store application and transacting with your customers you will be in receipt of personal information that may include; names, e-mails, addresses and other contact or location information. You will also have access to their purchase history for transactions where you are the seller.
    1. If you extract and store this information from Inzu, you must provide your customers with a GDPR-compliant privacy policy, stating exactly how their information is used, how it can be accessed and how it can be removed from your records.
    2. You agree to not share any information submitted to the My Store application with any third party unless you have the express permission of the customer whose information you are sharing.
  2. You accept that, in the case of credit/debit card payments, limited customer and product information will be sent to and retained by Stripe. In such cases the privacy policy of Stripe applies in addition to the Agreement.
  3. You accept that, in the case of PayPal payments, customer and product information will be sent to and retained by PayPal. In such cases the privacy policy of PayPal applies in addition to the Agreement.
